1. MINUTES FROM JANUARY 2015 MEETING. MOTION TO APPROVE MINUTES FROM JANUARY 2015 MEETING BY ANN MARIE, SEC JOE, 3/0.

2. CORRESPONDENCE: FROM: DEP INFORMING FELL TOWNSHIP THAT THE LOCATION OF ALL OUTFALLS MUST BE SHOWN, NAMED AND MAPPED TO INCLUDE THE ENTIRE STORM SEWER COLLECTION SYSTEM. THIS IS A MAJOR PROJECT. FROM: DAVID BOGUSKI REQUESTING THE REMOVAL OF A CHAIN LINK FENCE INSTALLED BY A NEIGHBOR ON TOWNSHIP RIGHT-OF-WAY. THE FENCE INTERFERES WITH MANEUVERING FROM HIS DRIVE WAY AND REMOVAL OF SNOW. FROM: TOM DEACHER REQUESTING A RURAL POSTAL BOX NUMBER.

OLD BUSINESS

1. FELL TOWNSHIP IS SOLICITING COMMENTS FOR INFRASTRUCTURE WORK FOR NEXT YEAR. THIS INCLUDES ROAD WORK, PAVING, STORM DRAINS, VACANT BUILDINGS AND POLICY CHANGES. SUGGESTION RECEIVED WAS TO DEMOLISH ABANDONED HOUSE ON 1 JEFFERSON STREET. IN PROGRESS.

2. THE WALL AT MONKEY RUN PARK ALONG MAIN STREET. ONE SUGGESTION RECEIVED WAS TO IMITATION STONE. THIS WOULD NOT REQUIRE A SOLID WALL TO ATTACH THE STONE. WE WILL EXPLORE THIS SUGGESTION.

3. THOMPSON PROPERTY (LOCATED ON 43RD STREET). THE OWNERS OF THE PROPERTY LOCATED ON 21, 43RD STREET COMPLIED WITH THEIR AGREEMENT TO DEMOLISH SAID PROPERTY. CLEANUP IS IN PROGRESS. REPAIR OF PROPERTY LOCATED ON 19, 43RD STREET IS PART OF THE AGREEMENT. REPAIR WILL OCCUR AS WEATHER PERMITS. THE SUPERVISORS WISH TO THANK ALL WHO MADE THIS AGREEMENT POSSIBLE.

4. BURNT BUILDING ON MAIN STREET. NO PLANS SUBMITTED BY OWNERS TO DATE.

5. BUILDING LOCATED ON 204 MORSE (MARJER) NO RESPONSE FROM CONTEMPT OF COURT CHARGES FILED BY THE TOWNSHIP. PROPERTY WAS LISTED FOR TAX SALE AND RECEIVED NO BIDS. PROPERTY WILL BE LISTED FOR JUDICIAL SALE DURING MARCH . THE PROPERTY WILL BE SOLD FREE AND CLEAR OF LIENS. THE OUTCOME OF THIS SALE WILL DETERMINE THE TOWNSHIP’S NEXT ACTION.

6. SIMPSON SEWER FUND UPDATE: COLLECTION STATUS: GOOD PROGRESS. WE ARE WORKING THE ACCOUNTS WITH BALANCES $500.00 AND OVER INDIVIDUALLY. MOTION TO APPROVE ALL SEWER ACCOUNT ADJUSTMENTS MADE TO DATE BY RON SEC BY ANN MARIE. CARRIED 3/0.

7. ABANDONED HOUSE ON 2 JEFERSON STREET. SUPERVISORS AWAITING RESPONSE FROM BANK.

8. CLEANUP OF BROWN FIELDS. NO RESPONSE FROM OWNERS. SOLICITOR WILL CONTACT COMPANY. THE SUPERVISORS INTEND TO HAVE THIS COMPLETED BEFORE THE HERITAGE AUTHORITY ENDS THEIR WORK ON THE TRAIL.

9. ZONING CORRECTION SECOND NOTICE. ZONING OFFICER, MR. CELBUSKY SUGGESTED THE ZONING MAP BE UPDATED TO REFLECT THE ACTUAL SITUATION ON SOUTH MAIN STREET ( FROM KERL OIL TO J-C MONUMENTS) FROM C-1 TO C-2. THIS WOULD BRING THE EXISTING BUSINESSES IN COMPLIANCE. SOLICITOR WILL SCHEDULE HEARINGS. PUBLIC COMMENTS?

10. DOG WALKERS STILL AN ISSUE. KEEP US INFORMED OF YOUR OBSERVATIONS.

2. DEP DRAFT STORMWATER PERMIT ISSUED FOR THE DISCHARGE OF STORM WATER FROM A REGULATED MUNICIPAL SEPARATE STORM (MS4) INTO LACKAWANNA RIVER AND WILSON CREEK. COMMENTS ON THIS MATTER WILL BE ACCEPTED BY DEP FOR 30 DAYS FOLLOWING PUBLICATION. INTERESTED PERSON MAY REVIEW THIS ISSUE BY CALLING 570 8226 5472. THE EVENTS REQUIRED BY THIS MATTER ARE OUTLINED ON THE REVERSE OF THIS AGENDA.

STORMWATER MANAGEMENT PROGRAM

2015

THERE ARE SIX MINIUM CONTROL MEASURES WHICH ARE REQUIRED BY FEDERAL REGULATIONS. THESE ARE:

1. PUBLIC EDUCATION AND OUTREACH ON STORMWATER IMPACTS.

A. IMPLEMENT A PUBLIC EDUCATION PROGRAM TO DISTRIBUTE EDUCATIONAL MATERIALS TO THE COMMUNITY OR CONDUCT EQUIVALENT OUTREACH ACTIVITIES. THE SUPERVISORS AND PLANNING COMMISSION WILL ADDRESS FIRE COMPANY MEETING, CHURCH MEETINGS AND SPORTS ACTIVIEIES TO SATISFY THIS ISSUE.

2. DEVELOP AND MAINTAIN LISTS OF TARGET AUDIENCE GROUPS IN YOUR AREA. THESE INCLUDE BUSINESSES, RESIDENTS, DEVELOPERS, SCHOOLS AND MUNICIPAL EMPLOYEES. THE SUPERVISORS WILL ADDRESS THIS REQUIREMENT BY THE ABOVE CITED METHOD.

3. THE TOWNSHIP MUST ANNUALLY PUBLISH ONE ISSUE OF A NEWS LETTER, PAMPHLET, FLYER, OR BY WEBSITE. WE WILL EMPLOY ALL METHODS.

4. THE TOWNSHIP MUST DISTRIBUTE STORMWATER EDUCATIONAL MATERIALS AND INFORMATION TO TARGET AUDIENCES USING A VARIETY OF METHODS, INCLUDING DISPLAYS, POSTERS, SIGNS, RADIO AND LOCAL TV. THE SUPERVISORS WILL PARTNER WITH OTHER OPERATORS TO SATISFY THIS REFQUIREMENT.

5. THE TOWNSHIP MUST DEVELOP, IMPLEMNET AND MAINTAIN A WRITTEN PUBLIC INVOLVEMENT AND PARTICIPATIONM PROGRAM WHICH DESCRIBES VARIOUS TYPES OF POSSIBLE PARTICIPATION ACTIVITIES AND DESCRIBES METHODS OF ENCOURAGING THE PUBLIC’S INVOLVEMENT AND OF SOLICITING THE PUBLICS INPUT.

6. THE TOWNSHIP REGULARLY SOLICIT PUBLIC INVOLVEMENT AND PARTICIPATION FROM THE TARGET AUDIENCE GROUPS. THIS SHOULD INCLUDEAN EFFORT TO SOLICIT PUBLIC REPORTING OR SUSPECTED ILLICIT DISCHARGES. CONDUCT PUBLIC MEETINGS TO DISCUSS THE ON-GOING IMPLEMENTATION OF THE PROGRAM.

MAJOR STEPS TAKEN TO DATE INCLUDE SEVERING ELECTRIC, WATER AND GAS FROM THE PROPERTY. THE PROPERTY WILL BE DEMOLISHED DURING THIS MONTH. THE SUPERVISORS WISH TO THANK ALL WHO MADE THIS AGREEMENT POSSIBLE.

OF THESE 52 ACCOUNTS 16 TOTAL $27,088.00 AND WILL BE COLLECTED BECAUSE THEY ARE IN LEGAL SITUATIONS SUCH AS BANKRUPTCY, DEATHS AND FORECLOSURE. WE ARE WORKING THESE ACCOUNTS INDIVIDUALLY.

7. ABANDONED HOUSE ON 2 JEFERSON STREET. SUPERVISORS AWAITING RESPONSE FROM BANK.

8. CLEANUP OF BROWN FIELDS. NO RESPONSE FROM OWNERS. THE SUPERVISORS INTEND TO HAVE THIS COMPLETED BEFORE THE HERITAGE AUTHORITY ENDS THEIR WORK ON THE TRAIL.

10. BOROUGH OF VANDLING INTER-MUNICIPAL AGREEMENT. DEVELOPERS ARE PLANNING A HOUSING DEVELOPMENT IN VANDLING CALLED MAPLE RIDGE. ONE ROAD, 7TH AVENUE, EXTENDS INTO FELL TOWNSHIP AND WILL CONNECT TO VALLEY VIEW TERRACE. FELL TOWNSHIP APPROVED THIS REQUEST IN 2010 WITH THE REQUIREMENT THAT THE TOWNSHIP ENJOY FREEDOM FROM LIABILITY AND OTHER COSTS. VANDLING WOULD RECEIVE LIQUID FUELS AWARDS. THIS IS THE FINAL APPROVAL. DISCUSSION? MOTION?

NEW BUSINESS
1. “DOG WALKERS” NOT CLEANING UP AFTER PETS STILL A PROBLEM. COMMUNICATE YOUR OBSERVATIONS TO THE SUPERVISORS AND WE WILL ADVISE WALKERS OF THEIR RESPONSIBILITY TO CLEAN UP VIA A POLITE WRITTEN NOTICE AS WE OBSERVE THEM.

2. DUNDAFF STREET SANITARY SEWER. SEWER LINE NEEDS REPAIR. THREE SECTIONS WERE COMPLETED DURING THE LAST FIVE YEARS. THE SECTION IN DISREPAIR IS 250 FEET IN LENGTH. SUGGEST THAT A GRANT FROM DCED BE REQUESTED. DISCUSSION? RESOLUTION?

7. ABANDONED HOUSE ON 2 JEFERSON STREET. RESPONSE FROM BANK EXPECTED ONCE PAPERWORK IS FINALIZED.

8. CLEANUP OF BROWN FIELDS. STUDY IN PROGRESS. TOWNSHIP WAS INFORMED THAT A GRANT WAS AWARDED TO HERITAGE AUTHORITY TO BUILD THE TRAIL FROM CARBONDALE TO A POINT ABOVE THE SIMPSON VIADUCT IN THE SPRING. COMMENTS FROM PLANNING COMMISSION?

1. TOWNSHIP RECEIVED COMPLAINTS ABOUT “DOG WALKERS” NOT CLEANING UP AFTER PETS. SINCE FEW READ THE PAPERS, SUPERVISORS WILL ADVISE WALKERS OF THEIR RESPONSIBILITY TO CLEAN UP VIA A POLITE WRITTEN NOTICE AS WE OBSERVE THEM. PLEASE REPORT YOUR OBSERVATIONS.

2. SUGGESTIONS REQUESTED FOR THE REPAIR OF THE WALL AT MONKEY RUN PARK ALONG MAIN STREET. THE CONCRETE IS SEVERELY DETERIORATED.

4. ROAD SALT. OUR ROAD SALT IS ON NORMAL DELIVERY. THE NOTE IN THE PAPER APPLIES TO OTHER AGENCIES.

5. EXTENSION OF POLICE CONTRACT. CARBONDALE’S OFFER IS FOR $85,000.00 FOR EACH OF THREE YEARS. LAST YEARS CONTRACT WAS FOR $75,000.00 BUT THERE WERE 200 MORE INCIDENTS THIS YEAR. 1. OLD FELL SCHOOL ROOF CAVED IN ON SATURDAY. TOWNSHIP SECURED AREA AND NOTIFIED OFFICIALS. OWNERSHIP IS IN THE PROCESS OF BEING TRANSFERRED TO DIMES FROM HEAVEN. THE STRUCTURE WILL BE EXAMINED TO DETERMINE IF CONDEMNATION IS IN ORDER.

2. JEFFERSON STREET PARK CLOSED–DRIVERS DRIVING ON THE BASEBALL FIELD LEAVING RUTS. THE FIELD WILL BE OPEN BY APPOINTMENT.

3. TRANSMISSION NEEDS REPAIR ON FORD F350. LOWEST FIRM BID FOR TOTAL REBUILD WITH 1 YEAR GUARANTEE IS KURILLA IN ARCHBALD FOR $2200.00. OTHER BIDS WERE ESTIMATES BASED ON CONDITION AFTER TEARDOWN. DISCUSSION? MOTION.

4. SHUST ROAD–EROSION DAMAGING TOWNSHIP ROAD. NEEDS LARGE STONES TO PROTECT BANK. BALL FIELD HAS ABOUT 3 LOADS AND VILANO PROPERTY HAS ONE. THE TOWNSHIP WILL HAUL.

BASEBALL FIELD UPDATE: MAIN FIELD LIGHTS INSTALLED AROUND THE FIELD. SNACK STAND AND OFFICE NEAR COMPLETION. MINI BASEBALL FIELD IN REAR AND ELECTRIC PLAYGROUND UNDER CONSTRUCTION.

BALL FIELD IS A GREAT AND POSITIVE CONTRIBUTION TO FELL TOWNSHIP’S FUTURE.
