SPECIAL MEETING TO ACCEPTS ROAD BIDS WAS HELD ON JULY 15, 2015. TWO BIDS WERE RECEIVED: WAYCO, $27,012.14 ; BEAR OWENS, $27,577.90. BID WAS AWARDED TO THE LOW BIDDER, WAYCO. BIDS WERE FOR ONTARIO, OBSUD AND FULTON STREETS.

1. MINUTES FROM THE JULY 2015 MEETING. MOTION TO APPROVE THE MINUTES FROM JULY 2015 MEETING?

1. RESIDENT REQUESTED INFRASTRUCTURE WORK FOR THIS YEAR COMPLETED SO FAR: PAVING OF OBSUD LANE, THE SOUTH END OF ONTARIO STREET, THE SOUTH SECTION OF FULTON STREET AND MILLING OF THE NORTH END OF CRAWFORD AVENUE WERE COMPLETED.

2. ZONING ORDINANCE. PLAYGROUND AT THE OLD FELL SCHOOL REQUIRES A ZONING CHANGE FROM A SCHOOL PLAYGROUND TO A PUBLIC PLAYGROUND. EVERYTHING REMAINS THE SAME. ZONING OFFICER , MR. CELBUSKY WILL CONDUCT THE HEARING. DISCUSSION? MOTION?

3. THE WALL AT MONKEY RUN PARK ALONG MAIN STREET. ESTIMATES EXPECTED FOR THIS JOB THIS MONTH.

4. THOMPSON PROPERTY (LOCATED ON 43RD STREET). REPAIRS TO LARGE BUILDING NOT COMPLETED. SECTION OF PORCH FELL ABOUT TWO FEET.

5. BURNT BUILDING ON MAIN STREET. NO PLANS SUBMITTED BY OWNERS TO DATE. ALSO, MAIN BUILDING ON LOT IS IN DANGEROUS CONDITION. SOLICITOR TO COMMENT.

6. BUILDING LOCATED ON 204 MORSE (MARJER) NO RESPONSE FROM CONTEMPT OF COURT CHARGES FILED BY THE TOWNSHIP.  AWAITING CERTIFICATION.

7. SIMPSON SEWER FUND UPDATE. ADDITIONAL REQUESTS RECEIVED TO PUBLISH THE DELINQUENT LIST. RESIDENTS ARE ANXIOUS TO EXTINGUISH THIS ACCOUNT AND ARE CONCERNED ABOUT NON-PAYERS. SOLICITOR SENT LETTERS TO THOSE WITH BALANCES DENOTING THE ACTION TO BE TAKEN TO COLLECT THE BALANCE. SOLICITOR TO COMMENT.

8. ABANDONED HOUSE ON 2 JEFFERSON STREET. AWAITING REPLY FROM THE MORTGAGE HOLDER.

9 CLEANUP OF BROWN FIELDS. SOLICITOR TO CONTACT PROPERTY OWNERS AND REQUEST INTENTIONS.

10. MIDLAND STREET BRIDGE. PENDOT WILL INSPECT THE BRIDGE SOMETIME, PROBABLY DURING AUGUST. BRIDGE REPLACEMENT WILL BE A MAJOR COST TO THE TOWNSHIP. WE WILL PLAN FOR THAT EVENT. SINCE THERE IS ONLY ONE ENTRANCE TO MIDLAND STREET A SECONDARY ROAD WILL NEED TO BE DEVELOPED.

11. RENTAL HOUSE ANNUAL REPORT. SOME STILL NOT RECEIVED. IF YOU DO NOT OCCUPY THE RESIDENCE A REPORT IS REQUIRED ANNUALLY. THIS INCLUDES AN OCCUPANCY PERMIT.

12. UNAUTHORIZED USE OF PROPERTY FOR AN AUTO STORAGE FACILITY ON MAIN STREET. SOLICITOR TO COMMENT.

NEW BUSINESS

1. PURCHASE USED FIRE TRUCK FROM CARBONDALE CITY FOR $2000.00. THIS WILL REPLACE OUR 1977 TRUCK. FIRE COMPANY COMMENTS? DISCUSSION? MOTION? NO PUBLIC COMMENTS. MOTION BY JOE, SEC BY ANN MARIE, CARRIED 3/0.

2. DREW ANDERSON CREATED A LAND SUBDIVISION ON PIERCE ROAD. ONLY ONE AREA WAS SUITABLE FOR A SEPTIC SYSTEM. TWO ARE RECOMMENDED BY DEP, HOWEVER THE TOWNSHIP CAN WAIVE THIS REQUIREMENT ON THE ADVICE OF THE SEWER ENFORCEMENT OFFICER WHICH WAS DONE. THIS FACT MUST BE INCLUDED IN FUTURE LAND SALE DISCLOSURES. 2. RESOLUTION AUTHORIZING SOLICITOR TO PREPARE AN AMENDMENT TO THE FELL TOWNSHIP ZONING ORDINANCE CLARIFYING “THE AUTOMOBILE SALES AND SERVICE AUTHORIZATION” IN BOTH C-1 AND C-2 ZONES. PRESENTLY, ONE SECTION ALLOWS SALES IN C-1 AND THE NEXT SECTION ALLOWS SALES IN BOTH C-1 AND C-2. DISCUSSION? MOTION? BY JOE, SEC RON, CARRIED 3/0.

3. RESOLUTION TO SPONSOR A “DIMES FROM HEAVEN” REQUEST FOR A GRANT OF $77,964.00 TO PURCHASE PLAYGROUND EQUIPMENT, A PAVILION AND BARBEQUE PITS FOR THE DIMES FROM HEAVEN PARK, SIMPSON, PA. THE GRANT, IF APPROVED, REQUIRES A MATCH GRANT OF 20% OR $19,491.00. THIS AND FEES WILL BE PAID BY AND THROUGH THE DIMES FROM HEAVEN FOUNDATION. DISCUSSION? MOTION? FORECLOSURE COMPANIES PAY OUTSTANDING SEWER BILLS, HOWEVER, SOME INDIVIDUALS DECLARED BANKRUPTCY IN AN ATTEMPT TO DISMISS THEIR OBLIGATION. UTILITY BILLS STAY WITH PROPERTY. ACCOUNTS WITH BALANCES OF $300.00 AND OVER TOTAL $89,000.00. THIS MUST BE COLLECTED IN ORDER TO EXTINGUISH THE SIMPSON SEWER FUND.

THERE ARE SIX MINIUM CONTROL MEASURES WHICH ARE REQUIRED BY FEDERAL REGULATIONS. THESE ARE:

1. PUBLIC EDUCATION AND OUTREACH ON STORMWATER IMPACTS.

A. IMPLEMENT A PUBLIC EDUCATION PROGRAM TO DISTRIBUTE EDUCATIONAL MATERIALS TO THE COMMUNITY OR CONDUCT EQUIVALENT OUTREACH ACTIVITIES. THE SUPERVISORS AND PLANNING COMMISSION WILL ADDRESS FIRE COMPANY MEETING, CHURCH MEETINGS AND SPORTS ACTIVIEIES TO SATISFY THIS ISSUE.

2. DEVELOP AND MAINTAIN LISTS OF TARGET AUDIENCE GROUPS IN YOUR AREA. THESE INCLUDE BUSINESSES, RESIDENTS, DEVELOPERS, SCHOOLS AND MUNICIPAL EMPLOYEES. THE SUPERVISORS WILL ADDRESS THIS REQUIREMENT BY THE ABOVE CITED METHOD.

3. THE TOWNSHIP MUST ANNUALLY PUBLISH ONE ISSUE OF A NEWS LETTER, PAMPHLET, FLYER, OR BY WEBSITE. WE WILL EMPLOY ALL METHODS.

4. THE TOWNSHIP MUST DISTRIBUTE STORMWATER EDUCATIONAL MATERIALS AND INFORMATION TO TARGET AUDIENCES USING A VARIETY OF METHODS, INCLUDING DISPLAYS, POSTERS, SIGNS, RADIO AND LOCAL TV. THE SUPERVISORS WILL PARTNER WITH OTHER OPERATORS TO SATISFY THIS REFQUIREMENT.

5. THE TOWNSHIP MUST DEVELOP, IMPLEMNET AND MAINTAIN A WRITTEN PUBLIC INVOLVEMENT AND PARTICIPATIONM PROGRAM WHICH DESCRIBES VARIOUS TYPES OF POSSIBLE PARTICIPATION ACTIVITIES AND DESCRIBES METHODS OF ENCOURAGING THE PUBLIC’S INVOLVEMENT AND OF SOLICITING THE PUBLICS INPUT.

OLD BUSINESS
1. FELL TOWNSHIP IS SOLICITING COMMENTS FOR INFRASTRUCTURE WORK FOR NEXT YEAR. THIS INCLUDES ROAD WORK, PAVING, STORM DRAINS, VACANT BUILDINGS AND POLICY CHANGES.

2. SUGGESTIONS REQUESTED FOR THE REPAIR OF THE WALL AT MONKEY RUN PARK ALONG MAIN STREET. THE CONCRETE IS SEVERELY DETERIORATED.

3. THOMPSON PROPERTY (LOCATED ON 43RD STREET). THE SUPERVISORS REACHED AN AGREEMENT WITH PROPERTY OWNERS WHICH REQUIRES THE OWNERS TO DEMOLISH THE PROPERTY LOCATED 0N 21 43RD STREET. MAJOR STEPS TAKEN TO DATE INCLUDE SEVERING ELECTRIC, WATER AND GAS FROM THE PROPERTY. THE PROPERTY WILL BE DEMOLISHED DURING THIS MONTH. THE SUPERVISORS WISH TO THANK ALL WHO MADE THIS AGREEMENT POSSIBLE.

4. BURNT BUILDING ON MAIN STREET. NO PLANS SUBMITTED BY OWNERS TO DATE.

5. BUILDING LOCATED ON 204 MORSE (MARJER) NO RESPONSE FROM CONTEMPT OF COURT CHARGES FILED BY THE TOWNSHIP. PROPERTY WAS LISTED FOR TAX SALE AND RECEIVED NO BIDS. PROPERTY WILL BE LISTED FOR JUDICIAL SALE DURING FEBRUARY WHICH WILL BE SOLD FREE AND CLEAR OF LIENS. THE OUTCOME OF THIS SALE WILL DETERMINE THE TOWNSHIP’S NEXT ACTION.

6. SIMPSON SEWER FUND UPDATE: COLLECTION STATUS: THERE ARE 52 ACCOUNTS WITH BALANCES OVER $500.00 TOTALING $81,115.00. OF THESE 52 ACCOUNTS 16 TOTAL $27,088.00 AND WILL BE COLLECTED BECAUSE THEY ARE IN LEGAL SITUATIONS SUCH AS BANKRUPTCY, DEATHS AND FORECLOSURE. WE ARE WORKING THESE ACCOUNTS INDIVIDUALLY.

10. BOROUGH OF VANDLING INTER-MUNICIPAL AGREEMENT. DEVELOPERS ARE PLANNING A HOUSING DEVELOPMENT IN VANDLING CALLED MAPLE RIDGE. ONE ROAD, 7TH AVENUE, EXTENDS INTO FELL TOWNSHIP AND WILL CONNECT TO VALLEY VIEW TERRACE. FELL TOWNSHIP APPROVED THIS REQUEST IN 2010 WITH THE REQUIREMENT THAT THE TOWNSHIP ENJOY FREEDOM FROM LIABILITY AND OTHER COSTS. VANDLING WOULD RECEIVE LIQUID FUELS AWARDS. THIS IS THE FINAL APPROVAL. DISCUSSION? MOTION?

NEW BUSINESS
1. “DOG WALKERS” NOT CLEANING UP AFTER PETS STILL A PROBLEM. COMMUNICATE YOUR OBSERVATIONS TO THE SUPERVISORS AND WE WILL ADVISE WALKERS OF THEIR RESPONSIBILITY TO CLEAN UP VIA A POLITE WRITTEN NOTICE AS WE OBSERVE THEM.

2. DUNDAFF STREET SANITARY SEWER. SEWER LINE NEEDS REPAIR. THREE SECTIONS WERE COMPLETED DURING THE LAST FIVE YEARS. THE SECTION IN DISREPAIR IS 250 FEET IN LENGTH. SUGGEST THAT A GRANT FROM DCED BE REQUESTED. DISCUSSION? RESOLUTION?
